These General Terms and Conditions of Sale are those of SARLU CHOJU, located at 9 rue des petits toits, 44350, Guérande – France. Its Siret number is 932 940 190 00014 and its intra-community VAT number is FR72 93294019000014 .

www.utileetordinaire.com is a commercial website accessible via the internet network, open to all users of this network.

This website allows Utile & Ordinaire to offer items for sale (hereinafter referred to as "products") to internet users browsing the site (hereinafter referred to as "users"). For the purposes of these terms and conditions, it is agreed that the user and Utile & Ordinaire shall be collectively referred to as the "parties" and individually as a "party," and that a user who has confirmed an order by sending payment shall be referred to as the "buyer." The rights and obligations of the user necessarily apply to the buyer.

ARTICLE 1 : Application of the general terms and conditions of sale


Any condition stipulated by the buyer that is not in accordance with Utile & Ordinaire's general terms and conditions of sale will be rejected unless Utile & Ordinaire has expressly acknowledged its applicability in writing. Utile & Ordinaire may modify these general terms and conditions of sale at any time, provided that such modifications are published on its website. Utile & Ordinaire undertakes to accept the buyer's orders in accordance with these general terms and conditions of sale.

ARTICLE 2 : Products

The products offered for sale by Utile & Ordinaire are those listed on the website on the day the user consults the site, subject to availability. If a product is unavailable, the buyer will be informed as soon as possible by email or telephone. The buyer will then have the option of choosing another product offered on the website or canceling their purchase. Photographs and texts illustrating the products are not contractually binding. Utile & Ordinaire cannot be held liable for any errors in these photographs and/or texts.

ARTICLE 3: Price

Prices are quoted in euros. They include any applicable discounts on the day of the order, significant changes in costs, and are subject to typographical errors or omissions. The offer and price are valid for the current two-week period. Prices do not include shipping and handling charges, which will be billed separately and specified to the User upon final order confirmation. Prices in other currencies are subject to the current exchange rate and the same validity conditions.

ARTICLE 4: Order Registration

4.1. Site Navigation

Users can view the various products offered for sale by Utile & Ordinaire on its website. Users can browse the different pages of the site freely, without being obligated to place an order.

4.2 Placing an order

By confirming the order, the buyer accepts all of these terms and conditions of sale, which are available on the website, and acknowledges having read and understood them fully. The buyer therefore waives the right to rely on any conflicting document, including their own general terms and conditions of purchase, as the act of purchasing constitutes acceptance of these terms and conditions of sale. This confirmation, along with all data recorded by Utile & Ordinaire, will serve as proof of these transactions. The order details will be sent to Utile & Ordinaire by email. Shipment of the models will take place within 4 business days of receiving payment.

Exception : Some items are available for pre-order. An estimated delivery date will be provided upon order confirmation. If the order contains multiple items, some of which are in stock, the entire order will be shipped upon receipt of the missing item. If the customer requires the available items before receiving the missing item, they must place a separate order or pay additional shipping charges.

ARTICLE 5: Delivery

Utile & Ordinaire will make every effort to ship orders within an average of four (4) business days from the day after payment is received. Unless otherwise specified, delivery will be made to the address provided by the buyer when placing their order. Products will be shipped via La Poste (French Postal Service) or Mondial Relay. Utile & Ordinaire accepts no liability for excessive delivery delays caused by postal services, nor for lost or damaged goods due to strikes. The buyer assumes all risks associated with shipping and must file a formal complaint with the postal service within three business days of delivery. Furthermore, ownership of the ordered products will only be transferred to the buyer upon full payment of the invoiced price, including delivery charges. That said, despite all the care taken by Utile & Ordinaire in preparing packages, an item may occasionally be missing. Similarly, after shipping, one of the items may be damaged. Therefore, upon receiving their order, the buyer must check that the items received are correct. Any anomaly concerning the delivery (missing item, incorrect model/color combination, damaged package) must be reported on the day of receipt or at the latest on the first business day following receipt to Utile & Ordinaire - 9 rue des petits toits, 44350, Guérande, France , or by email to contact@utileetordinaire.com. Any claim made after this period will be considered invalid, and Utile & Ordinaire will be released from all liability. Utile & Ordinaire reserves the right to ask the buyer to return the defective product. Return shipping costs will be borne by the buyer unless the return is due to an error on the part of Utile & Ordinaire. If the aforementioned conditions are met, Utile & Ordinaire will then either exchange or refund the defective product(s), or reship the missing product (subject to the validity of the buyer's request).

Parcels delivered via Mondial Relay

Your parcels will remain available at the collection point for 5 calendar days (delivery times may vary).

If we do not receive your order within this timeframe, it will be automatically returned to us.

An automatic refund will be issued directly to the payment method used for your order, at the latest 15 days after receipt of your package in our warehouses.

We will retain the original shipping costs, which remain payable to our carrier.

ARTICLE 6: Retention of Title

The delivered goods remain the property of Utile & Ordinaire until the buyer has fulfilled all its obligations to Utile & Ordinaire, and in particular until full payment of the price, including any applicable interest. This retention of title does not preclude the transfer of risk, which will pass to the buyer from the date the ordered goods leave Utile & Ordinaire's premises, in accordance with the provisions of Article 5.

ARTICLE 7: Right of withdrawal & returns

The buyer has fourteen (14) business days to return the product(s) ordered if they are not entirely satisfied. This period begins on the day the order is received. The product(s) must be returned in their original packaging to the following address: Utile & Ordinaire - 9 rue des petits toits , 44350, Guérande , France. If the aforementioned conditions are met, Utile & Ordinaire will reimburse the buyer within thirty (30) days of the date of receipt of the package by Utile & Ordinaire (the date of receipt being considered proof). After this fourteen (14) day period, the delivered products will be deemed to conform to the buyer's order and accepted by the buyer.

Return shipping is free for all purchases within Metropolitan France. Return shipping costs remain the responsibility of the customer for all purchases made outside Metropolitan France.

ARTICLE 8: Payment

The order will only be validated by Utile & Ordinaire after receipt and verification of payment. In any event, Utile & Ordinaire reserves the right to refuse any order or delivery in the event of a dispute with the buyer, or total or partial non-payment of a previous order by the buyer. If the buyer is late in paying the price, Utile & Ordinaire will be entitled to claim late payment interest at the average effective rate charged during the previous quarter by credit institutions for consumer loans. If Utile & Ordinaire can demonstrate the existence of damages exceeding the amount of the late payment interest, due to the buyer's delay in payment, Utile & Ordinaire will be entitled to claim compensation for these damages.

8.1. Taxes

Value Added Tax is not applicable to sales made by the website utileetordinaire.com under Article 293 B of the General Tax Code.

ARTICLE 9: Data Processing and Freedoms

9.1. Personal Information

Providing the personal information collected during the online sales process is mandatory, as this information is necessary for processing and delivering orders, as well as for issuing invoices. This information is strictly confidential. Failure to provide this information will result in the automatic rejection of the order.

ARTICLE 10: Miscellaneous Provisions

10.1. Force majeure

Utile & Ordinaire will not be responsible for the total or partial non-performance of its obligations under this contract, if such non-performance is caused by an event constituting force majeure, in particular in the event of disruption or total or partial strike of postal services and means of transport and/or communications, fire, floods, failure or breakdown of equipment, or due to the actions of the buyer.

Pay in installments with Alma

Payment in installments/deferred payment is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Purchase amount

  • P2X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
  • P3X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
  • P4X: Only purchases between €50 and €2,000 are eligible for payment with Alma.

Costs

By paying in installments with Alma, the Customer does not pay any fees.

Alma is a tele-payment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the civil code.

Termination

Any termination of the General Terms and Conditions of Sale which bind the Seller and the customer, entails the termination of the General Terms and Conditions of Use between Alma and the customer.
